This Privacy Policy explains how Asset Built LLC (“Asset Built,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit assetbuilt.com, submit information, request services, join a marketing list, communicate with us, register to bid in or participate in an Asset Built auction, or use related online features that link to this Policy (collectively, the “Site”).

By using the Site, you acknowledge the practices described in this Policy. Where consent is required by law, we will request it separately. This Policy does not replace transaction-specific notices, auction terms and conditions, contracts, or the privacy policies of independent third-party platforms.

Scope and our role

Asset Built LLC is a Wyoming limited liability company that provides asset transaction, advisory, auction, sale, acquisition, real estate, consulting, matching, and related services. This Policy applies when Asset Built determines why and how personal information is processed through the Site and through our auctions.

We conduct our auctions using an auction platform provider (currently BidSpotter). When you register to bid, you agree to Asset Built's own bidder terms and conditions presented on that platform. Asset Built determines how that bidder information is used, and the platform provider processes it on our behalf as a service provider, consistent with this Policy.

Other transactions — such as payments, signatures, or activity on a separate platform that is not operated on Asset Built's behalf — may be governed by that platform's own privacy policy, under which the third party may collect information independently from Asset Built. Please review the notice presented on that platform before providing information.

Personal information we collect

• Contact and identity information: Name, email address, telephone number, company, job title, mailing or billing address, and similar contact details.
• Property, asset, and opportunity information: Property addresses; descriptions, photographs, documents, and characteristics of real estate, equipment, business assets, or other opportunities; ownership or representative capacity; timing; requested services; and related submission details.
• Investment and commercial preferences: Investment interests, financial goals, asset preferences, acquisition criteria, transaction objectives, industry, and information needed to evaluate or match a requested opportunity.
• Communications and marketing information: Messages, inquiry details, call or correspondence records, form submissions, marketing preferences, consent records, unsubscribe or opt-out choices, and responses to email or text campaigns.
• Payment and transaction information: When payment is available, an independent payment processor collects payment card, bank, billing, or similar details. Asset Built generally receives transaction information such as payer name, amount, status, date, and a limited account reference rather than complete card or bank credentials.
• Device and online activity information: IP address, browser and device type, operating system, referring pages, pages or content viewed, links clicked, approximate location derived from IP address, timestamps, advertising identifiers, cookie identifiers, and interaction data collected through cookies, tags, pixels, forms, email tracking, and similar technologies.
• Information from other sources: Information received from our auction platform provider, other service providers, CRM and lead-management systems, marketing platforms, payment processors, business partners involved in a requested matching or referral, public records, professional networks, and lawful public or commercial sources.

How we collect information

• Directly from you: For example, when you submit a contact, property, asset, investment, or request form; register to bid in an auction and agree to our bidder terms and conditions; join an email or text list; make a payment; participate in a transaction; or communicate with us.
• Automatically: When you use the Site, cookies and related technologies may collect device and usage information. The Site currently uses Google Tag Manager to help manage website tags and may use analytics or advertising tools deployed through it.
• From third parties: We may receive information from our auction platform provider, vendors, referral sources, transaction participants, social-media or advertising platforms, and other sources described above.

How we use personal information

• Provide and respond: Respond to inquiries; provide requested information or services; communicate about assets, properties, transactions, events, registrations, payments, and support; and administer our relationship with you.
• Evaluate and match: Review properties, assets, opportunities, investment interests, and financial goals; evaluate potential transactions; and match users with requested services, assets, purchasers, sellers, advisors, or referral partners.
• Operate and improve: Operate, maintain, personalize, troubleshoot, secure, and improve the Site and our services; measure audience and campaign performance; understand how visitors use the Site; and develop new services.
• Market and advertise: Send promotional or newsletter emails and, with the consent required by law, recurring or automated marketing texts; create audiences; measure campaigns; and deliver or evaluate targeted advertising and retargeting.
• Process transactions: Facilitate payments through a third-party processor, maintain transaction records, prevent fraud, and meet accounting, tax, contractual, and legal obligations. We do not use complete payment card or bank credentials for targeted advertising.
• Protect and comply: Verify identity and authority; detect, investigate, and prevent security incidents, fraud, misuse, or unlawful activity; enforce agreements; resolve disputes; exercise or defend legal claims; and comply with law.

Cookies and analytics

We and our vendors use cookies, web beacons, pixels, tags, software development tools, and similar technologies to keep the Site functioning, remember settings, understand traffic, measure communications, and support advertising. These technologies may associate Site activity with activity on other websites, apps, or services.

Browser settings can be used to block or delete cookies, though doing so may affect Site features. We do not currently operate a cookie-management tool and do not currently recognize browser-based opt-out signals such as Global Privacy Control or “Do Not Track.” If you have questions about our use of cookies or targeted advertising, contact us using the information in this Policy.

Email and text-message marketing

Marketing choices are separate from a request for services. You may unsubscribe from promotional email by using the link in the message or contacting us. We may still send nonmarketing messages about an inquiry, transaction, payment, security, or our continuing business relationship.

If you register to bid in an Asset Built auction through our auction platform provider, you will be asked to agree to our bidder terms and conditions before you can participate. Those terms include your consent to receive text messages from us about auctions, bidding activity, and related account or transaction matters, and message and data rates may apply. Reply STOP to opt out of text messages and HELP for help, or contact us using the methods below. We maintain records of consent and opt-out requests and honor revocation requests submitted through any reasonable method, consistent with applicable FCC requirements.

How we disclose personal information

• Service providers: Website hosting and form providers; our auction platform provider; CRM and lead-management providers; email-marketing and text-message providers; analytics and advertising providers; payment processors; cloud, communications, security, professional, and other vendors that process information for Asset Built.
• Requested matching and referral partners: Affiliates, transaction participants, advisors, purchasers, sellers, service professionals, or other business partners when reasonably necessary to fulfill a matching, referral, introduction, evaluation, or other service you request.
• Advertising partners: Advertising and social-media partners may receive identifiers, device data, and online activity through cookies or pixels to deliver, measure, or improve targeted advertising and retargeting, subject to applicable law.
• Legal and safety recipients: Courts, regulators, law enforcement, government authorities, counterparties, insurers, and advisors when reasonably necessary to comply with law, protect rights or safety, investigate misconduct, or establish, exercise, or defend claims.
• Business transactions: Potential or actual buyers, investors, lenders, insurers, advisors, or successors in connection with a merger, financing, reorganization, sale of assets, bankruptcy, receivership, or similar transaction, subject to appropriate safeguards.
• At your direction: Other recipients when you direct us, request the disclosure, or give consent.

We do not sell personal information for money or rent lead lists. Contact us using the information in this Policy if you have questions about how information is shared.

U.S. state privacy disclosures

Some U.S. state privacy laws give residents of that state specific rights regarding their personal information, such as the right to know, access, correct, or delete information, and to opt out of certain uses. Whether a particular law applies to Asset Built depends on factors such as the volume of information we process and our revenue. Where a law applies to you and to us, we will honor the rights it provides.

An authorized agent may submit a request where permitted, but we may require proof of authorization and may need to verify your identity directly.

We will respond within the period required by applicable law.

International visitors

Asset Built is based in the United States, and personal information may be processed in the United States or other countries where we or our providers operate. Those locations may have privacy laws different from those in your country. Where required, we use lawful transfer mechanisms and other safeguards for international transfers.

If the law in your location applies, our legal bases may include performing a contract or taking steps at your request; your consent; our legitimate interests in operating, securing, improving, and marketing our services; and compliance with legal obligations. Depending on local law, you may have rights to access, correct, erase, restrict or object to processing, receive portable data, withdraw consent, and complain to a data-protection authority. Contact us to exercise those rights. Withdrawal of consent does not affect processing already performed lawfully.

Data retention

• Inquiry and lead records: Generally retained for two years after the last meaningful interaction, unless a longer period is reasonably necessary for an active opportunity, dispute, legal obligation, or your request.
• Marketing records: Retained while you are subscribed or while consent remains valid. We may retain suppression records after an unsubscribe or withdrawal so that we can honor the choice.
• Property and transaction records: Retained as long as legally or operationally necessary for the relevant property, asset, auction, payment, referral, contract, accounting, tax, compliance, dispute, or recordkeeping purpose.
• Cookie and analytics information: Retained under our configuration and the applicable vendor's retention settings, subject to legal requirements and your choices.

When a retention period ends, we delete, deidentify, or securely dispose of information where reasonably practicable, subject to backups, legal holds, and information needed to document compliance or defend legal claims.

Security

We use administrative, technical, and physical safeguards designed to protect personal information. No website, transmission, or storage system is completely secure, and we cannot guarantee absolute security. Use caution when sending sensitive information through ordinary email or open-text fields. Payment details should be entered only in the payment processor's designated secure interface.

Age restrictions

The Site is intended for adults. Visitors under 18 may browse publicly available content, but they may not submit forms, provide personal information, join email or text marketing lists, or use transaction features. We do not knowingly collect personal information through the Site from anyone under 18. If you believe a minor submitted information, contact us so we can review and delete it as appropriate.

Third-party sites and services

The Site may link to or integrate with payment, social-media, video, map, or other third-party services that are not operated on Asset Built's behalf. Asset Built does not control their privacy or security practices. This Policy applies only to Asset Built's practices, so review the third party's privacy policy before providing information.

Changes to this Policy

We may update this Policy to reflect changes in our practices, services, vendors, or legal obligations. We will post the revised Policy on the Site and update the effective or last-updated date. If required by law, we will provide additional notice or obtain consent for material changes.

SMS

Program scope

These SMS Terms and Conditions govern the AssetBuilt text messaging program operated by Asset Built LLC (“AssetBuilt,” “we,” “us,” or “our”). By opting in, you agree to receive the message types described in your consent and to these terms. These terms supplement our Privacy Policy and do not replace applicable auction terms, purchase agreements, or removal obligations.

Messages you may receive

Depending on your consent, messages may include responses to inquiries and customer support; auction registration and bidding updates; transaction and payment-status notices; appointment, pickup, and removal coordination; and service-related reminders. By agreeing to put Terms and Conditions and Privacy policy, we may also send promotional messages about upcoming auctions, available assets, and AssetBuilt services. Messages may be recurring or sent using automated technology.

Consent and participation

SMS participation is voluntary and is not a condition of purchasing goods or services or participating in an auction. Providing a telephone number, accepting general auction terms, or requesting services does by itself enroll you in promotional texts. We obtain and maintain the consent required for the applicable message category by agreeing to the following Privacy Policy and SMS Terms and Conditions provided. If you initiate a text conversation, we may respond to that inquiry. ,You must be at least 18 and the subscriber or authorized user of the number provided. Notify us if your number changes or is reassigned.

Frequency and charges

Message frequency varies based on your preferences, inquiries, transactions, and auction activity. Message and data rates may apply under your mobile carrier plan. AssetBuilt does not charge a separate subscription fee for this messaging program. Contact your carrier about messaging charges.

Opting out and getting help

Reply STOP to any AssetBuilt text to opt out. We also honor other clear requests to stop, including requests sent to info@assetbuilt.com or made by calling (213) 753-3875. You may receive one non-promotional confirmation of your opt-out. After processing your request, we will stop messages covered by that request unless you provide fresh consent. Opting out does not cancel an existing transaction or change your auction obligations; we may communicate through other permitted channels. Personal Data and Program Administration

Information collected and used

We collect and use your mobile number, contact details, message content and attachments, messaging preferences, consent and opt-out records, and relevant delivery and interaction information to operate the program. We use this information to respond to you, provide authorized updates, maintain consent records, honor opt-outs, troubleshoot delivery, protect against misuse, and meet legal obligations. Related auction or transaction information is handled as described in our Privacy Policy.

Protection of mobile opt-in data

We do not sell, rent, or share mobile numbers collected for this program, mobile opt-in data, or text-message consent with third parties or affiliates for their marketing or promotional purposes. Text-message consent is specific to AssetBuilt and is not transferred to others for their own messaging programs. We may provide the minimum information necessary to service providers, including RingCentral and telecommunications providers, solely to deliver and support our messaging on our behalf, or disclose information when required by law. These limited disclosures do not authorize recipients to use your information for their own marketing. The broader sharing provisions in our Privacy Policy do not authorize sharing SMS opt-in data or consent for third-party marketing.

Retention, security, and privacy requests

We retain messaging and consent records as reasonably necessary to administer the program, document compliance, resolve disputes, and satisfy legal obligations. We may retain suppression records after an opt-out to honor your choice. Other retention practices and applicable privacy rights are described in our Privacy Policy. We use safeguards designed to protect personal information, but text messaging is not completely secure. Delivery and availability

Delivery depends on mobile carrier coverage, device compatibility, and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Text notifications are a convenience; consult your auction account, invoice, or applicable agreement for binding deadlines and requirements. The program is not an emergency service.
